Most utility companies such as Electricity, Water, Gas and Telecommunications have certain rights to access your land in the event of an emergency to undertake repairs to restore supplies. The rights are covered by statute and certain provisions are allowed for compensation of damage and disturbance.
Therefore, if you have had electricity pole replacement following the recent storms and damage has occurred to hedges/ fences and land itself, a claim will need to be formulated to monetise that compensation. Do not be discouraged by the contractor’s claim that “we won’t make much mess, don’t worry”!! The legislation covering such works allows the payment of agent’s fees in assessing and formulating a claim for the landowner with these fees paid by the utility company so you will not be out of pocket.
The same compensation provision is also available for the installation of new apparatus by utility companies on land and early engagement with your agent on such matters is advised.
